Ts & Cs

Licence to Occupy

All occupants (Containers & Buildings) must agree to and sign a basic Licence to Occupy Agreement at the start of each tax year

Notice Period

Licensees (occupants) can give the required notice period and leave at any time throughout the year. This is within 5 working says of the start of the month if they wish to leave by the end of the same month or they will be liable for the following month’s rent also.

The Licensor (Landlord) is required to give a minimum of one full month’s notice if they wish to end the Licence Agreement.

Annual Renewal

Renewal Invitations setting out storage licence terms for the next financial year are sent out around the end of January each year and Licensees have until 5 working days into the start of March to either accept them or give notice that they will be leaving by the end of March.

Payment

Payments for the standard containers and units within the buildings are chargeable monthly in advance. Payment (preferably by standing order) are due within 5 working days of the start of each month.

For occupancies that start after the 1st of the month, a pro-rata rate will apply.

Deposit

Existing Licensees / Renewals = £0

New Container Storage Licence = £50

New Buildings Storage Licence = 50% of 1 month’s rent

Deposits need to be paid in cash and subject to none of the Licence Agreement terms being breached (e.g. failure to return any borrowed item), they are fully refundable. The cash will be returned to the Licensee at the end of occupation.

Electricity

Electricity is supplied to Units within the farm buildings only. An agreed electricity reading will be taken at the start and at regular intervals and the Licensee will be invoiced for electricity units used in addition to a proportion of the standing charge as appropriate. Payment to the electricity supplier comes from one central source (the Licensor) rather than from individual Licensees.

Note: The daily standing charge is split between all occupants of the farm buildings and is payable, regardless of usage levels due to Licensees having the option to use a supply of electricity services.

More Details (As extracted from the Licence Agreement)

  1. Basis of Agreement

Th3 Agreement constitutes a personal Licence to Occupy an allocated Storage Unit for the sole purpose of storing permitted goods. It does not grant the Licensee exclusive possession of any specific part of the building that the Storage Unit is in or ground that it sits on, nor does it create any tenancy, leasehold interest, or relationship of landlord and tenant between the Licensor and the Licensee.

The Licensee explicitly acknowledges and agrees that the protections, security of tenure, and rights to renewal afforded to business tenants under Part II of the Landlord and Tenant Act 1954 are entirely excluded from this Agreement.

The Licensor retains overall possession, management, and control of the Storage Unit at all times. The Licensee’s rights under this Agreement are purely contractual.

The Licensor reserves the right, upon giving not less than fifteen (15) days’ notice (or immediately in the event of an emergency), to require the Licensee to relocate their stored goods to an alternative, equivalent storage unit on the same site.

    2. Default

The Licensor has the right to end the Agreement without giving any notice period if any Fee or other sums are regularly paid late (i.e. beyond the due date) or if the Licensee frequently needs chasing or reminding to make payment on a timely basis.

The Licensor has a contractual lien on all goods, items, effects, and professional equipment that are in storage at any time for any fees or other charges due and payable by the Licensee under this Agreement. In the event of an uncorrected default the Licensor is contractually authorised to withhold access to the goods in storage and retain physical possession of them until all outstanding balances are settled in full.

    3. Deemed Abandonment

If the Licensee is in default of payment, the storage unit remains locked or unused and the Licensee fails to communication for a continuous period of fourteen (14) consecutive days, the storage unit and all contents shall be contractually deemed permanently abandoned by the Licensee. The Licensor reserves the immediate contractual right to sell or otherwise dispose of the Licensee’s stored items by public auction or private sale, to recover outstanding debts, accrued storage fees, and disposal costs and need not account to the Licensee for any proceeds.

    4. Permitted Use

Only non-hazardous, legal and inert personal or business property can be stored

      5. Locks

These can be borrowed or self-supplied
